The Attorney spearheading Operation Establish Compliance, the challenge to New Jersey’s One Gun a Month Law, and Osterweil v. Bartlett
Attorney Daniel Schmutter is a rising star in the gun rights legal arena who has firmly established his presence among the country’s leading Second Amendment lawyers through his skilled representation of clients and his passionate advocacy for the protection of our constitutional right to keep and bear arms. He represents the interests of NJ2AS in Operation Establish Compliance, which seeks to compel New Jersey municipalities to comply with mandatory State firearms licensing procedures. Dan also represents the Association of New Jersey Rifle and Pistol Clubs in challenging New Jersey’s One Gun a Month Law and is lead counsel in challenging New York’s unconstitutional prohibition on handgun possession by part year residents in Osterweil v. Bartlett.
Dan submitted amicus curiae briefs to the United States Supreme Court in Heller and McDonald and was cited by Justice Samuel Alito in the court’s decision in McDonald. He was interviewed on the impact of McDonald on New Jersey firearms law for the Fox Business Network program “Freedom Watch” in 2010, and his commentary on New Jersey gun laws has been published in the Star Ledger and the Bergen Record
